On Tuesday, May 17, the Moscow City Court began considering an appeal by the defense against the sentence against Alexei Navalny, who was found guilty of fraud and contempt of court, RBC correspondent reports.

Navalny filed a motion to postpone the meeting for a week, justifying this by saying that he was not familiar with the audio recording of the sentencing, in which his defense had previously found inaccuracies. “Foundation number 2 may seem technical to you, because you are in the wild. It's important for me. I am in a general regime colony. I have a long meeting with relatives once every three months. And now, literally from the 16th, the time has come when I have the right to have this date. I applied in time, it is scheduled for the 20th. If you approve my sentence, I will be transferred to a strict regime colony. No one understands how everything will be arranged there. In a normal situation, a person is in a pre-trial detention center, but I am in a general regime colony, I have the right to this visit. There I will have even fewer dates, and this date will burn out. I have every right to receive it: I served 3 months, I have the right to see relatives, — he said, speaking via video link from the colony.

The judge noted in response that Navalny had previously stated that he did not want to get acquainted with the audio recording of the meeting. The oppositionist explained that he would like to get acquainted with the record not of the meeting in its entirety, but of the verdict. The judge granted the petition and rescheduled the meeting for May 24.

On March 22, the Lefortovsky District Court, at an off-site meeting, which took place in correctional colony (IK) No. 2 of the Vladimir Region, sentenced Alexei Navalny to nine years in prison in a strict regime colony and a fine of 1.2 million rubles.

The verdict of the Lefortovo court stated that “Navalny committed fraud, that is, theft of other people's property by deception.” He was found guilty on all four counts of large-scale fraud imputed to him (part 4 of article 159 of the Criminal Code). According to investigators, Navalny participated in the creation of Internet sites and social networks containing exposing information about the corruption of officials and forms for collecting donations. These Internet resources were, according to investigators, part of a plan to embezzle money that was spent inappropriately.

Navalny called the materials of the criminal case evidence of the transparency of the work of the Anti-Corruption Fund (it was recognized by the court as an extremist organization and liquidated). “You brought materials to the court about four people who made donations of 2 million rubles. And one of them— this is a locksmith who made a donation of 1 million rubles, and two weeks later wrote a statement, and the next day a criminal case was initiated, — he said in court.

The oppositionist pleaded not guilty, linking the charges to his activities.

After the trial meeting in the Vladimir correctional colony, lawyer Olga Mikhailova told reporters that nine years in prison included the term of imprisonment provided for by the earlier verdict in the Yves Rocher case. Earlier, in this case, Navalny was sentenced to three and a half years in prison, but in February 2021, the suspended sentence was replaced with a real one.
